01 Acceptance of terms

These Terms & Conditions ("Terms") govern your access to and use of the Zeal Biolab website and your purchase of any products from us, including The Performance System™, Execute™, Reset™, and any related products (the "Products"). They form a binding agreement between you and Zeal Biolab Pty Ltd, trading as Zeal Biolab ("we", "us", "our").

By browsing our website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website or purchase our Products.

02 Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to purchase from us. By placing an order, you confirm that you meet this requirement and that the information you provide is accurate and complete.

03 Products & descriptions

We aim to describe our Products, including ingredients, imagery, and packaging, as accurately as possible. However, slight variations in appearance, formulation, or packaging may occur between batches. Colours shown on screen may also vary slightly from the physical product due to display settings.

We reserve the right to modify, discontinue, or update the formulation, packaging, or availability of any Product at any time without prior notice, though we will make reasonable efforts to inform subscribers of material changes.

04 Orders & payment

All prices are listed in Australian Dollars (AUD) unless otherwise stated, and are inclusive of applicable taxes unless noted at checkout. We reserve the right to change pricing at any time, though changes will not affect orders already confirmed.

• Placing an order constitutes an offer to purchase; we reserve the right to accept or decline any order for any reason, including suspected fraud, pricing errors, or stock unavailability
• Payment is processed securely by our third-party payment provider at the time of order
• You are responsible for ensuring your payment and shipping details are accurate and current
• Where instalment or "buy now, pay later" options are offered, those services are governed by the relevant provider's own terms

05 Subscriptions

Our Monthly Subscription delivers Product automatically on a recurring basis (currently every 28 days) at the subscriber discount shown at checkout, until cancelled.

• Subscriptions carry a minimum commitment of 3 billing cycles (approximately 84 days) from your first order
• You may skip or pause an individual upcoming shipment at any time through your account or by contacting us, without affecting your subscription status
• You may cancel your subscription at any time; cancellations take effect from your next scheduled billing date and do not entitle you to a refund of shipments already processed
• Cancelling before the minimum term is completed may result in the subscriber discount being adjusted or forfeited for prior shipments, in line with the terms accepted at signup
• We will notify you by email in advance of any change to your subscription price, formulation, or billing frequency where required by law
• Your payment method will be automatically charged on each billing date; please ensure your payment details remain current to avoid delivery interruptions

06 Shipping & delivery

We aim to dispatch orders promptly and will provide tracking information where available. Delivery timeframes shown at checkout are estimates only and are not guaranteed. Risk of loss and title to Products passes to you upon delivery to the shipping address provided.

You are responsible for providing an accurate delivery address. We are not liable for delays or non-delivery caused by incorrect address details, courier delays, or circumstances outside our reasonable control.

07 Returns & refunds

Nothing in these Terms limits your rights under the Australian Consumer Law, including your right to a refund, repair, or replacement for Products that are faulty, not as described, or do not do what they are meant to do.

• If a Product arrives damaged, faulty, or incorrect, contact us within 30 days of delivery and we will arrange a replacement or refund
• For change-of-mind returns, unopened Products in original, resaleable condition may be returned within 30 days of delivery; opened sachets or boxes cannot be returned for hygiene and safety reasons
• Shipping costs for change-of-mind returns are the customer's responsibility unless the return is due to our error
• Refunds are issued to the original payment method once a return is received and inspected, where applicable

08 Health & safety

• Consult your doctor or healthcare professional before use if you are pregnant, breastfeeding, taking medication, or have an existing medical condition
• Discontinue use and seek medical advice if you experience any adverse reaction
• Always read the label and follow the directions for use; do not exceed the recommended daily intake
• Keep out of reach of children
• Individual results vary. Any testimonials or results referenced on our website reflect individual experiences and are not a guarantee of results for any particular person

09 Intellectual property

All content on our website, including text, graphics, logos, product names, packaging design, and images, is owned by or licensed to Zeal Biolab Pty Ltd and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of our website or branding without our prior written consent.

10 Acceptable use

When using our website, you agree not to:

• Use the site for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorised access to our systems, accounts, or data
• Interfere with or disrupt the operation of the website or servers
• Use automated tools to scrape, copy, or extract content without our permission

11 Reviews & user content

If you submit a review, testimonial, comment, or other content to us (including via email or social media), you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with promoting our Products, unless you tell us otherwise. You are responsible for ensuring any content you submit is accurate, lawful, and does not infringe the rights of others.

12 Limitation of liability

To the maximum extent permitted by law, Zeal Biolab Pty Ltd excludes all liability for any indirect, incidental, or consequential loss arising from your use of our website or Products. Where our liability cannot be excluded under the Australian Consumer Law, our liability is limited, at our option, to the replacement or resupply of the Product, or the cost of doing so.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under applicable law.

13 Indemnity

You agree to indemnify and hold Zeal Biolab Pty Ltd harmless from any claim, loss, or damage, including reasonable legal fees, arising from your breach of these Terms or your misuse of our website or Products.

14 Third-party links

Our website may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, accuracy, or practices of any third-party site, and including a link does not imply our endorsement.

15 Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state in relation to any dispute arising from these Terms or your use of our website.
